Passing by the slim margin, Virginia lawmakers passed HB 961 to the Senate for vote. This measure is to ban the sale of ‘assault style’ weapons. Democrats in the Virginia Senate only have a 2 seat lead meaning they can only afford to lose one vote should all the Republicans oppose the bill.

Supporters say the proposed legislation is a response to mass shootings. Seven other states already have laws prohibiting assault-style weapons, including New York and California.

A Colorado gun control bill that would allow the seizure of firearms
from “high risk” individuals was heard Thursday in the House Judiciary
Committee, after being reintroduced in the statehouse last week.

The bill, co-sponsored by House majority leader Alec Garnett, describes an extreme risk protection order which allows family, household member, or an officer to petition a judge to lawfully take away the weapons in possession by any arms-bearing individual. Supporters, including several gun control groups, say it will help remove the threat of gun violence from people experiencing a mental health crisis.

How many Californians tried to register their firearms as “bullet-button assault weapons” before the July 1 deadline? How long will it take DOJ to process those registrations? How much did it cost Californians? See some of our research and findings below for the answers.

FAST FACTS

DOJ had approved 6,213 individuals to register 12,519 firearms as of June 30, 2018

DOJ processed 2,723 applications for firearm registration between Aug. 3, 2017, and Jan. 4, 2018

DOJ processed 12,168 applications for firearm registration between Jan. 5, 2018, and June 30, 2018

DOJ still had 52,443 applications for firearm registration pending as of June 30

Based on the rate of their application processing between January and May 2018, it would take DOJ 2.15 more years to finish processing the remaining “assault weapon” applications

The “assault weapon” registration system was originally estimated to cost DOJ $55,770 – 429 man-hours at $130.00 per hour – but over $113,370 was spent on programming alone to add DOJ’s BBAW system into its CFARS system

$119,970 in fees had been collected from gun owners through May 30, 2018

DOJ received funding to hire 24 analysts and two managers to process “bullet-button assault weapon” registration applications – “limited term positions that will cease to exist one year after these employees’ start dates.”

FAIRFAX, Va. — A three-judge panel of the 9th Circuit issued a ruling in the case of Duncan v. Becerra on Tuesday upholding a lower court’s decision to suspend enforcement of California’s restriction on the possession of magazines that hold 10 rounds or more.

“This is a significant win for law-abiding gun owners in California,” said Chris W. Cox, executive director, National Rifle Association Institute for Legislative Action. “This unconstitutional law criminalizes mere possession of many standard capacity magazines and would instantly turn many law-abiding gun owners into criminals.”

California Rifle and Pistol Association lawyers, with the support of the NRA, sought an injunction against the magazine possession ban, arguing the law violated the Second Amendment as well as Americans’ due process rights. A federal district court judge agreed and issued a preliminary injunction before the law was set to go into effect. California appealed the decision.

On Tuesday, the 9th Circuit upheld the injunction.

Meanwhile, in the trial court, a motion for summary judgment is pending and a ruling on the merits of the case is expected soon. Regardless of the outcome, the case will most certainly be appealed again to the 9th Circuit. By that time, the Supreme Court will likely have a new justice who respects the right to keep and bear arms as protected by the Second Amendment.

“Tuesday’s ruling was a step in the right direction. The National Rifle Association will continue to fight for the rights of Californians to protect themselves,” Cox concluded.

The Democratic governor said he would sign the bills, establishing some of the “toughest gun laws in the nation.”

The Democratic-led Senate approved the bills that began advancing after a fatal high school shooting in Parkland, Florida, that left 17 people dead in February.

“This is our response to our national crisis,” said Democratic state Sen. Richard Codey, who served as governor from 2004 to 2006. “We need national legislation.”

Murphy wrote on Twitter Thursday night that he would sign the bills on Wednesday. He campaigned on a promise for more “sensible” gun control laws.
